Vote on Mobility Package in TRAN committee

On January 10, the TRAN Committee of the European Parliament held a vote on the amendments tabled to the draft reports on the social and market pillar proposals under the first Mobility Package.

Compromises on two of the three legislative files in the package were rejected, Rapporteur’s compromise on the third legislative file was adopted. As these legislative files are strongly linked, it is currently unclear how the European Parliament will move forward with the package, given that only one of the reports was adopted:

  • Rejected: Enforcement requirements and specific rules for posting drivers in the road transport sector
  • Rejected: Amending Regulation (EC) No 561/2006, Daily and weekly driving times, minimum breaks and rest periods and positioning by means of tachographs
  • Adopted: Amending Regulation (EC) No 1071/2009 and Regulation (EC) No 1072/2009, Adapting to development in the road transport sector: The compromise amendments tabled by Rapporteur Ismail Ertug (S&D, DE) were adopted.

Essential elements in the adopted compromise amendments by MEP Ertug:

  • Amendment 19: vehicles must return to the Member State of establishment at least once every four weeks
  • Amendment 60: cabotage operations are limited to a maximum of 3 days, with an unlimited amount of operations permitted in this time
  • Amendment 61: Following cabotage operations, hauliers may not undertake cabotage operations in the same Member State within 60 hours after return to the haulier’s Member State of establishment, AND until a new international transport operation has been performed originating from the Member State of establishment.
