Posting of workers

Transport services will be excluded from the scope of the Posting of Workers Directive. They will be dealt with in the Mobility Package legislation. However, ESC is not satisfied with the proposals included in the package.

The European Parliament decided to exclude the transport services from the scope of the Posting of Workers Directive. ESC is happy that transport will be dealt with in a dedicated legislation being part of the Mobility Package. This legislation could take into account the peculiarities of transport much more than the general legislation.

Regarding the general legislation, the Posting of Workers Directive, the background here is that workers (for instance, in a construction sector) get the same wage as national workers from day one of their employment in another member state than that of their establishment. Also, non-local workers can work in a foreign country as a posted employee only for a limited period of time.

The specific transport legislation on posting of workers will be discussed in the European Parliament and Council in the coming months. However, ESC is not satisfied with the proposals included in the Mobility package as they will result in too much administrative burdens, will not sufficiently consider the present lack of drivers, and will freeze the existing differences in the level of wages across Europe.
